Swiss and international arbitration

In commercial disputes, the parties may, by mutual agreement and subject to certain conditions, decide to submit any present or future dispute to an arbitral tribunal, which will take the place of the normally competent state courts, and render a decision, known as an arbitral award, through a simplified procedure. As a general rule, the arbitration award cannot be challenged through the ordinary appeals process.

Most potential commercial disputes can be submitted to an arbitral tribunal, whether they concern domestic or international commercial relations. In principle, each party appoints an arbitrator of its choice. The two chosen arbitrators then designate by mutual agreement the third arbitrator. The award is made by majority vote.
